Privacy Policy

This Privacy Policy applies to all personal information collected by Yuma IT Pty Ltd (ABN 62 684 389 839) (we, us or our) via the website located at os.yumait.com.au (Website), including the contact form. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Account and organisation data in the YumaOS application is described in theYumaOS app privacy policy. Thesecurity page describes product controls. It is not a substitute for this policy.

1. What information do we collect?

The kind of Personal Information that we collect from you will depend on how you use the Website. The Personal Information which we collect and hold about you may include:

name, work email address, organisation name, role, optional phone number, the operational problem you describe, infrastructure preference, IP address, and browser metadata (including cookies and user agent).

We do not create accounts on this Website. We do not collect payment card details.

2. Types of information

The Privacy Act 1988 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.

Personal Information means information or an opinion about an identified individual or an individual who is reasonably identifiable:

  1. whether the information or opinion is true or not; and
  2. whether the information or opinion is recorded in a material form or not.

If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as Personal Information and will not be subject to this privacy policy.

Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

We do not collect Sensitive Information through this Website, and we ask that you do not send it. If we ever hold Sensitive Information it will be used by us only:

  1. for the primary purpose for which it was obtained;
  2. for a secondary purpose that is directly related to the primary purpose; and
  3. with your consent or where required or authorised by law.

3. How we collect your Personal Information

  1. We may collect Personal Information from you whenever you input such information into the Website (including the contact form) or provide it to us by email at hello@yumait.com.au.
  2. The contact form uses Cloudflare Turnstile to distinguish a person from an automated submission. For that check we pass the connecting IP address of the submitting device. A hidden website field is a honeypot: if it is filled we reject the submission and do not keep it.
  3. We may also collect cookies from your computer which enable us to tell when you use the Website. As a general rule, however, it is not possible to identify you personally from our use of cookies. We do not use advertising cookies.
  4. Where reasonable and practicable we collect your Personal Information from you only. Enquiry contents are delivered to hello@yumait.com.au and held in that mailbox. We do not write enquiries into a marketing database on this Website.

4. Purpose of collection

  1. We collect Personal Information to respond to your enquiry, decide whether YumaOS is a fit, arrange a discovery conversation if it is, protect the form from automated abuse, and meet our legal and record-keeping obligations.
  2. We customarily only disclose Personal Information to our service providers who assist us in operating the Website. On this Website that is Cloudflare, which hosts the site, runs Turnstile, and delivers the enquiry email to our inbox. Your Personal Information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties. We do not sell Personal Information.
  3. If you have asked us about YumaOS, we may contact you about that enquiry and about closely related YumaOS services. We will only use your Personal Information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from us. We do not use Sensitive Information in direct marketing. Our messages include a simple means by which you can request not to receive further communications of this nature, or you can email hello@yumait.com.au. Using this Website is not consent to receive marketing.

5. Security, Access and correction

  1. We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification or disclosure. Those steps include encryption in transit, an origin check on the form, Turnstile, and a size limit on submissions. When we no longer require your Personal Information for the purpose for which we obtained it, we will take reasonable steps to destroy or de-identify it. Unsuccessful enquiries are kept while we need them to reply, then deleted on request or when they are no longer needed. Records of a commercial engagement are generally kept for a maximum of 7 years to fulfil our record-keeping obligations. Where we must keep a record for a legal reason we will retain it for that reason alone and tell you when that applies.
  2. If an eligible data breach occurs (unauthorised access, disclosure or loss that is likely to cause serious harm), we will notify affected people and the Office of the Australian Information Commissioner as soon as practicable. We do not notify every incident.
  3. The Australian Privacy Principles:
    1. permit you to obtain access to the Personal Information we hold about you in certain circumstances (Australian Privacy Principle 12); and
    2. allow you to correct inaccurate Personal Information subject to certain exceptions (Australian Privacy Principle 13).
  4. Where you would like to obtain such access, or to correct or delete information we are not required to keep, email hello@yumait.com.au. There is no charge to make a request. We will respond within 30 days. We may ask you to verify your identity. If we refuse a request we will tell you why in writing, and explain how to complain about that decision.

6. Complaint procedure

If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us on the contact details set out at the bottom of this policy. We will acknowledge your complaint within five business days and give you a written response within 30 days. We may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner atoaic.gov.au/privacy/privacy-complaints, or by phone on 1300 363 992.

7. Overseas transfer

We are likely to disclose Personal Information to an overseas recipient. Cloudflare is a United States company. A request, a Turnstile check, or an enquiry email may be handled at whichever Cloudflare location is nearest, which can be outside Australia. We do not choose that location. Where information is handled outside Australia we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles. We remain accountable under Australian Privacy Principle 8.
